If not, the comment seems appropriate, since the President is asking that the laws be faithfully executed without “discretion”-which in this context would be a political act.On twitter.com

@jacklgoldsmith That is to say, I think there’s a distinction (perhaps unimportant for optics) between asking DOJ to use its discretion against your opponents and demanding that they *not* inject their own institutional political/PR considerations into a duty in the law that has no discretion.Permalink On twitter.com
