@OrinKerr I’m not sure the bedrock idea of stare decisis changes much per se, since the lower courts do as they’re told. But with Ramos, and soon with Dobbs, SCOTUS takes massive steps towards declaring that they’re not bound by it, as they aren’t bound by much else (say, ethics rules).On twitter.com

@OrinKerr As usual, Democratic appointees will face the question their political counterparts do. Republicans have torn down a bunch of norms and precedent, and they can respond with more of that, but it will destabilize the country and erode yet more norms. So do they?Permalink On twitter.com
