That they’re not judges bound to the logical legal consequences of their sparse and poor legal arguments nor the fever-dream histories their recent decisions rest on.       Do I prefer the reality where for the next few years, it’s unlikely these lawless despots will cancel the rights of people they hate? Sure. But we can’t go on for long if the rule of law is replaced by a tug of war between unelected legislating and the threat of public blowback.

    Others have said it more eloquently, but these aren’t decisions making legal arguments referring to our laws. At least, not any the authors take seriously. Instead, they’re lengthy policy tracts concerned with the court’s conviction about what it wants. Anti-canon at its purest.
