Prof. Sachs is being polite and giving the benefit of the doubt here. You don’t read Blackman’s work and say “this is a strong argument founded in the law.” He’s a partisan who applies a thin veneer of legal-ish reasoning to policy goals, and he’ll ditch originalism to get it. @StephenESachs/1460094097843175425On twitter.com
