@RDEliason @tribelaw I don’t know Prof. Tribe’s view here, but certainly some regard 2USC §194 as being a legal obligation, and not an invitation to weeks of dithering (which made it look like public pressure worked) over some 1980s era power grab memo that DOJ wouldn’t dare test in court.
